RESOLUTION NO.

RESOLUTION TEMPORARILY AMENDING RESOLUTION R20120216 ESTABLISHING A ONE-TIME REFUND FOR UNUSED PORTIONS OF UNEXPIRED PUNCH CARDS DUE TO 2015 FARE INCREASE

WHEREAS, Skagit County owns and operates a vehicle and passenger ferry (herein "ferry") between Anacortes, Washington, and Guemes Island, Washington; and

WHEREAS, on July 9, 2012, the Board of Skagit County Commissioners (Board) adopted Resolution R20120216, regarding nonrefundable punch cards and liability for lost or stolen punch cards at the Guemes Island Ferry; and

WHEREAS, it is the desire of the Board to raise ferry fares, effective October 1, 2015, in order to meet the revenue target for 2015, as set forth in Resolution R20100050, amended by R20110382; and

WHEREAS, sales for all frequent-user punch cards, at the old rates, will cease upon execution of this resolution; and

WHEREAS, most vehicle and motorcycle punch cards are valid for 90 days from the date of purchase, and persons have paid for such punch cards that may not be used completely prior to their expiration and the implementation of the fare increase; and

WHEREAS, passenger punch cards are valid for one year from the date of purchase, and persons have paid for such punch cards that may not be used completely prior to their expiration and the implementation of the fare increase; and

WHEREAS, it is the desire of the Board to temporarily amend Resolution R20120216, to allow for a one-time refund for unused portions of unexpired punch cards due to the anticipated 2015 ferry fare increase (as provided herein); and

WHEREAS, for the purposes of this resolution, unexpired punch cards shall be defined as those punch cards with an expiration date of September 30, 2015 or later; and

WHEREAS, punch cards stamped with an expiration date occurring before September 30, 2015, shall not be eligible for any refund; and

WHEREAS, the temporary one-time refund established by this resolution shall also apply to vehicle convenience punch cards (which will expire upon the anticipated fare increase).

NOW, THEREFORE, BE IT RESOLVED AND IT IS HEREBY ORDERED, that the Board temporarily amends Resolution R20120216, and authorizes a onebme refund to holders of unused portions of unexpired punch cards, as defined herein; specifically, refunds shall be applied in amounts according to the following schedule:


a) 20-Trip Vehicle & Driver - $6.80 per unused trip
b) 20-Trip Vehicle & Senior/Disabled Driver -  $5.95 per unused trip
c) 20-Trip Motorcycle & Rider - $4.25 per unused trip
d) 20-Trip Motorcycle & Senior/Disabled Rider - $3.40 per unused trip
e) Peak-10 Trip Vehicle & Driver - $10.00 per unused trip
f) Non-Peak 10-Trip Vehicle & Driver - $8.00 per unused trip
g) Peak 10-Trip Vehicle & Senior/Disabled Driver - $9.00 per unused trip
h) Non-Peak 10-Trip Vehicle & Senior/Disabled Driver - $7.00 per unused trip
i) 25-Trip Adult Passenger - $2.12 per unused trip
j) 25-Trip Senior/Youth/Disabled Passenger - $1.28 per unused trip

NOW, THEREFORE, BE IT RESOLVED AND IT IS HEREBY FURTHER ORDERED, that all such refunds are to be made through the Accounting Office of the Public Works Department (located at 1800 Continental Place, Mount Vernon, WA 98273) between October 1, 2015 and October 30, 2015. Refunds shall be issued by check, and will take up to 30 days to process. Refunds will not be issued at the Anacortes ferry terminal. Passengers shall surrender punch cards at the time of refund request. Requests for refunds submitted after October 30, 2015 shall not be considered, and a refund will not be issued. The temporary amendment of Resolution R20120216 established by this resolution shall automatically expire at the close of business on October 30, 2015, and Resolution R20120216 shall otherwise continue unmodified and in full force and effect thereafter.
